The tribe claim of the petitioner of belonging to " Naikda" Scheduled Tribe is pending before respondent No.2/Scrutiny Committee since 15.07.2025.

It is informed across the bar by the learned A.G.P. that the hearing of the proceedings is already concluded and the final order would be passed within a period of six weeks from today. 4.

The learned counsel for the petitioner submits that during pendency of the tribe claim of the petitioner, his employer has issued a show cause notice on 09.01.2026 calling upon him to submit the tribe validity certificate, failing which his service would be brought to an end.

Considering the same, we direct the respondent/ tribe committee to decide the tribe claim of the petitioner within a period of six weeks from today.

Till the tribe claim of the petitioner is decided, the employer of the petitioner shall not take coercive action against the petitioner solely on the ground of non submission of tribe validity certificate. 7.

We make it clear that protection granted by this Court will operate only till the tribe claim of the petitioner is decided and the petitioner will not claim equities.
