Present writ petition is filed with following prayer : "B) To set-aside decision and order passed by the Ld. SubDivisional Officer, Ahilyanagar in RTS Revision No.65/2025, dated 14.11.2025, and the order passed by ld, Tahsildar in Rasta Case No.42/2022 may kindly be restored in the interest of justice." 2.
Apparently, the dispute in present writ petition arises out of proceeding under Mamlatdar's Courts Act. The petitioners are owners of Gat No.280/1 and 280/3, whereas, respondent no.1 is owner of Gat No.280/2 situated at Village Pokhardi, Taluka and District Ahilyanagar. It was contention of respondent that petitioners have obstructed customary way available to him for enjoyment of land Gat No.280/2. The proceedings before Tahsildar was dismissed, however, in revision filed before Sub-Divisional Officer, prayer of respondent was granted.

During pendency of this writ petition, parties have arrived at amicable settlement and placed on record terms of such settlement, which are duly verified by them. It is agreed between parties that 12 feet road would be constructed by owners of Gat No.280/1, 280/2 and 280/3 within a period of one month and both parties would be entitled to use such way without any obstruction. The parties are present before this Court and affirms terms of settlement. They accept their signatures.
