The Petitioners pray that the application filed by Respondent No.3-Trust under Section 41A of the Maharashtra Public Trusts Act, 1950 be directed to be decided out of turn within a particular time limit.

All litigants are equal in the eyes of law. Each litigant desires that his case be decided at the earliest. Merely because the litigant has the capacity to approach the High Court, does not mean that the High Court would pass an order of granting an out of turn hearing to any litigant, giving him a special status and directing the Sonali

913-WP-1544-2026.odt authority to decide his case by jumping the queue. In issuing such direction, other litigants who are in queue, will feel that injustice has been done to them.

In view of the above, we are not issuing any direction to the Competent Authority to decide the application filed under Section 41A by Respondent No.3-Trust, out of turn. It may be decided by the Competent Authority, in queue, considering the date of lodging of such applications by various litigants, in the pending cases.

This Petition is dismissed.
