Ganesh Laxman Alure v. The State Of Maharashtra And Others
( 1 )
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 912 WRIT PETITION NO. 1604 OF 2026 Ganesh Laxman Alure
VERSUS
The State Of Maharashtra And Others ...
Mr. Omprakash Totawad h/f Mr. C. R. Thorat, Advocate for Petitioner. Mr. K. B. Jadhavar, AGP for Respondent-State. CORAM : KISHORE C. SANT & SUSHIL M. GHODESWAR, JJ.
DATE : 5th MAY 2026.
PC :- 1.
Heard the parties.
2.
The petitioner by way of this petition had challenged the judgment and order dated 17.12.2025 passed by Respondent No.2-Scheduled Tribe Certificate Verification Committee Kinwat, Head Office, Chh. Sambhajinagar, whereby the tribe claim of the petitioner as belonging to "Mannervarlu" Scheduled Tribe came to be rejected. 3.
The learned Advocate for the petitioner produces on record a copy of order dated 27.03.2026 passed by this Court in WP/1613/2026. This
( 2 ) Court, by way of said order, had directed to issue tribe validity certificate to the real sister of the petitioner namely, Varsha Laxman Alure. The same was granted conditionally. The claim of the present petitioner and his real sister (Varsha Alure) was rejected by common judgment and order dated 17.12.2025.
4.
We finds that the recent position is not disputed by the learned AGP. We find no difficulty in allowing the petition partly by granting conditional validity to the petitioner. Hence, the following order:
ORDER
(a) The writ petition is partly allowed.
(b) The impugned order dated 17.12.2025 passed by Respondent No.2Scrutiny Committee is hereby quashed and set aside. (c) Respondent No.2-Scrutiny Committee is directed to issue validity certificate to the petitioner of belonging to "Mannervarlu", Schedule Tribe which shall be subject to final outcome of the matter to be reopened by Respondent No.2-Scrutiny Committee in respect of one Nandu Ramlu Alure, on whose validity the petitioner and other blood relatives are placing reliance.
( 3 ) (d) The petitioner shall not claim any equities. (e) With these, writ petition stands disposed off. [SUSHIL M. GHODESWAR, J.] [KISHORE C. SANT, J.] D.A.ETHAPE
