The State Of Maharashtra Through Its Principal Secretary And Others ......
Mr. Pralhad V. Bachate, Advocate for Petitioner (absent) Mr. Abhijit M. Phule, AGP for Respondent No. 1 and 2 Mr. Akshay Radikar, Advocate for Respondents No.3 and 4. ......
CORAM : SMT. VIBHA KANKANWADI AND HITEN S. VENEGAVKAR, JJ.
DATE : 16 MARCH, 2026 PER COURT :- 1.
Learned advocate Mr. Akshay Radikar submits that he has instructions to appear for respondents No. 3 and 4. He places on record a copy of the communication dated 12.02.2026 addressed by respondent No. 4 to the petitioner, which is taken on record and marked as Exhibit 'X'. By the said letter, it is stated that the administrative approval to the work involved in e-tender notice No. 128 for the year 2025-2026 has been cancelled and, consequently, the entire process of the said e-tender stands cancelled.
2.
The present petition was filed for directions to respondents No. 3 and 4 to issue a work order in favour of the petitioner in view of the fact that the petitioner was found entitled to get the said work under
16-WP-1609-26.odt {2} the e-tender. Now, when the administrative approval itself has been cancelled, the petition has become infructuous. We, therefore, dispose of the petition. If at all any right is created in favour of the petitioner to challenge the same, the petitioner is at liberty to initiate appropriate proceedings.
