Heard the learned Counsel for the parties.

When the Court expressed its disinclination to entertain the petition, the learned Counsel for the petitioner submits that, the issue of correct valuation of the suit claim and proper Court fees be directed to be framed and decided without being influenced by the observations in the impugned order. 3.

The submission appears justifiable. The Trial Court is requested to frame the issue of correct valuation of the suit claim and proper court fees and decide the same along with other issues that may arise for adjudication in the suit. 4.

While deciding the issue of correct valuation and proper Court fees, the trial Court shall not be influenced by any of the SAINATH 1/2

40 WP 1715-26.DOC observations made in the impugned order as well as the order dated 23rd June, 2025, passed on application (Exh. 17). 5.

Subject to aforesaid clarification, the petition stands disposed.

The learned Civil Judge is requested to hear and decide the suit as expeditiously as possible.
