The present petition has been filed seeking a direction to the Respondents to pay the interest amount payable under Section 80 of the Act of 2013, and in this regard, the Petitioners submitted a representation dated 05.05.2025 to the office of the Respondent Collector, Beed, as well as to Respondent Nos. 3 and 4. 2.
The brief facts, in short, are that the Petitioners' land came to be acquired for the construction of Village Tank No. 6 at Warani, Tq. Shirur Kasar, Dist. Beed. The process of acquisition, by way of a preliminary notification under Section 11 of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 [hereinafter referred to as the "new Act"], commenced on 10.03.2022, and possession of the acquired property was taken on 16.03.2004, however, the Award came to be declared on 30.05.2024. Accordingly, the Petitioners state that the compensation amount has been accepted by them, but their grievance pertains to the interest that has accrued on the compensation amount, which has not been determined and paid to them as required under Section 80 of the
2 940wp1759.2026.odt new Act. The Petitioners submit that, for the payment of the said interest in accordance with Section 80 of the new Act, they submitted a representation on 05.05.2025. However, the said representation has not been decided to date, and the Petitioners have been deprived of the interest amount payable to them in accordance with law. 3.
Since the relief claimed by the Petitioners is limited to a decision on their representation by Respondent Nos. 2 and 3, the learned AGP has tendered a copy of the communication dated 17.02.2026 received from the office of Respondent No. 3, wherein it is stated that an appropriate decision as to whether interest is payable to the Petitioners under Section 80 of the new Act will be taken within a period of three months from today. The said communication is taken on record and marked as "X" for the purpose of identification. 4.
Accordingly, we dispose of the Writ Petition by directing Respondent Nos. 2 and 3 to decide the Petitioners' representation dated 05.05.2025 in accordance with the statement made by them in the communication dated 17.02.2026.
