The Writ Petition is filed with following prayer clause B'. "B. By issuing appropriate writ, order or directions in the like nature, the impugned order dated 26.12.2025 passed by the respondent no.3 i.e. Divisional Commissioner Chh. Sambhajinagar in No.2024/ Grampanchyat/appeal-2/Pra.Kra.193 may kindly be quashed and set aside and for that purpose issue necessary orders." 2.

Mr. Khadap, learned Advocate appearing for Petitioner submits that order impugned in Petition is already subjected to appeal before Hon'ble Minister. However, neither appeal is taken for hearing nor any order is passed in application for stay. He submits that Hon'ble Minister is under statutory obligation to decide appeal within statutory period. However, it has been delayed without any reason.

In light of submissions advanced, present Writ Petition can be disposed of by passing following order.

ORDER

(i) The Hon'ble Minister is requested to consider and decide petitioner's appeal filed under Section 39(3) of Maharashtra Village Panchayat Act, 1968 within a period of six weeks from today. (ii) In the meantime, application filed by petitioner seeking stay of execution of order passed by Divisional Commissioner be taken for hearing and decided within a period of three weeks from today. (iii) Till decision on stay application, the operation and implementation of order impugned in appeal before Hon'ble Minister shall stand stayed.
