The grievance raised by the Petitioners in the present petition pertains to non-payment of rental compensation to the Petitioners in pursuance to the land which has been acquired by the Irrigation Department for the purpose of construction of percolation tank No. 4. He submits that the possession of the land of the Petitioners was taken by way of private negotiation by Respondent/authorities on 07.05.2005 and the acquisition proceeding by way of notification under Section 4 was initiated by the authorities on 25.10.2012.

- 2 - wp1820.26.2.odt Though the award has been passed in the year 2013 and the amount of compensation has been paid and received by the Petitioners, rental compensation as on date has neither been decided nor paid to them by the authorities. He submits that they have preferred an application/representation to the Respondent/authorities on 02.03.2023 claiming rental compensation in accordance with Government Resolutions dated 02.04.1979 and 01.12.1972 wherein the rental compensation is required to be paid to the land owners in pursuance of acquisition of their land from the date of acquisition till final realisation of the compensation. He, therefore, prays that the representation which is pending with the Respondent/authorities be decided.

Learned AGP submits that the representation dated 02.03.2023 will be decided by Respondent No. 3 within a period of 8 weeks from today. The statement of learned AGP is accepted by way of undertaking to this Court with a direction to Respondent No. 3 to decide the representation within a period of 8 weeks from today. Writ petition stands disposed of accordingly.
