The Petitioners have put forth Prayer Clauses (A), (B), and (C) which read as under :

(A) hold and declare that, the petitioner no. 1 - Sayyed Jahangir Sayyed Naim is a nominated councilor of Nagar Panchayat, Barshiktakli, Tq. Barshiktakli, Dist. Akola recommended by Bhartiya Rashtriya Congress Party as per the position existing on 13.01.2026 i.e. date of special meeting for selection / election of nominated councilors and further direct the respondent no. 2 - Collector, Akola and respondent no. 3 - Presiding Officer / President, Nagar Panchayat, Barshitakli, Ta. Barshikatli, District Akola to take steps accordingly ;

(B) during pendency of the present petition, direct the respondent no. 2 - Collector, Akola to consider the nomination of the petitioner no. 1 - Sayyed

Jahangir Sayyed Naim recommended by Bhartiya Rashtriya Congress Party as per the position existing on 13.01.2026 i.e. date of special meeting for selection / election of nominated councilors, in the interest of justice ;

(C) during pendency of the present petition direct the respondents not to nominate any candidate in the any upcoming meeting of Nagar Panchayat, Barshitakli, Tq. Barshikatli, District Akola. 2.

The learned Advocates for the Petitioners have prayed for ad-interim relief. We are not inclined.

The learned Advocates for the Petitioners submits that in Rajaram Appa Patil vs. State of Maharashtra & Ors, Writ Petition No. 246 of 2017, an interim order was passed on 21.12.2017. The District Collector had refused the nomination. In the instant case, the representation of the Petitioners is pending before the District Collector. No order has been passed.

As such, we direct the District Collector to decide the said representation by 6:00 p.m. today, by considering the law as applicable. Since the meeting of the Barshitakli Nagar Panchayat, District Akola, is scheduled to be held tomorrow, the decision shall be communicated accordingly.
