This writ petition takes exception to the order dated 17.2.2026 passed by the Hon'ble Minister (Gram Panchayat Development Department) in Proceeding No.VPA - 2026/Pra.Kra.36/P.R.6.

It appears that the substantive appeal filed by the respondent/Sarpanch under section 39 (3) of the Maharashtra Village Panchayats Act is pending consideration before the Hon'ble Minster. By impugned order, Hon'ble Minister granted stay to the order of removal of Sarpanch passed by the learned Divisional Commissioner, Chhatrapati Sambhajinagar. 3.

Mr. Gundre learned advocate appearing for the petitioner submits that, since stay was not granted in appeal by

wp 1975.26.odt the Hon'ble Minister, charge is handed over to PetitionerUpsarpanch. At present, petitioner is in-charge Sarpanch of village Panchayat Killari.

In the aforesaid backdrop, when substantive appeal filed by the respondent is pending consideration before the Hon'ble Minister, instead of delving in merit of contentions, it would be appropriate to see that appeal is decided expeditiously and within a period of four (4) weeks from today. In this background, the order impugned need not be interfered. 5.

In result, writ petition stands disposed of with request to Hon'ble Minister to decide the pending appeal within a period of four (4) weeks from today. ( S. G. CHAPALGAONKAR, J. ) ...
