IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO.1991 OF 2026 Azamuddin Sharfuddin Mulani/Inamdar ... Petitioner

Versus

Zahiruddin Sharfuddin Mulani/Inamdar and Ors.

.... Respondents **** Adv. Pratik B. Rahade i/b. Adv. Nilesh Wable, for the petitioner. Smt. P. J. Gavhane, AGP, for the respondent-State. Adv. Sumit Khaire, for respondent Nos.1 and 2. **** CORAM :

M. S. KARNIK & S. M. MODAK, JJ.

DATE :

5th MARCH, 2026 P.C. :

1.

Heard learned counsel for the parties.

2.

The petitioner by this Writ Petition prays for a direction to the Hon'ble Revenue Minister to decide the Revision Application expeditiously. We are not inclined to grant such a relief in favour of the petitioner at this stage. The Revision Application was filed on 23rd January 2026. This Writ Petition was filed on 27th January 2026. We are conscious of the workload of the Hon'ble Revenue Minister and hence no case is made out for expediting the hearing of the Revision Application.

3.

Learned AGP opposed the Writ Petition. We find substance in the submission of the learned AGP. 4.

However, learned counsel for the petitioner submitted that along with the Revision Application, an application for stay/grant of interim reliefs has been filed which is at page 87 of the paper-book. It is submitted that the revenue entries which were settled for almost 30 years are changed to the detriment of the petitioner by the order which is impugned before the Hon'ble Revenue Minister. It is the submission of learned counsel for the petitioner that the petitioner therefore has a prima facie case on merits and hence it is necessary that the stay application has to be decided expeditiously. If a request is made to the Hon'ble Revenue Minister for appropriate interim reliefs, we do not see any reason why such a request shall not be entertained since it's a question of considering the application for grant of interim reliefs.

We request the Hon'ble Revenue Minister to consider the application for grant of ad-interim/interim reliefs expeditiously and preferably within a period of six weeks from today. The petitioner to remain present before the Hon'ble Revenue Minister on 12th March 2026 at 11:00 a.m.

5.

Keeping all contentions open, the Writ Petition is disposed of.
