IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 906 WRIT PETITION NO. 1995 OF 2026 Vishwanath Kashinath Bhusare And Another

VERSUS

The State Of Maharashtra Through Its Principal Secretary And Others ...

Mr. Baliram B. Shinde - Advocate for the Petitioners Mr. S. B. Pulkundwar - AGP for the State Mr. Akash Gade - Advocate for Respondent No.4 ...

CORAM : SMT. VIBHA KANKANWADI AND HITEN S. VENEGAVKAR, JJ.

DATED : 24TH MARCH, 2026 PER COURT : - 1.

The learned AGP, Mr. S. B. Pulkundwar, has produced a Demand Draft drawn in the name of the Registrar of this Court and submits that, although this Court had directed in its order dated 04.03.2026 that the Office of the Land Acquisition, Vaijapur, should pay costs of Rs. 30,000/- to Petitioner No. 1 and deposit a cheque or Demand Draft in the name of the said Petitioner, the same was brought yesterday but was not accepted by the Office. Therefore, by cancelling the earlier Demand Draft issued in the name of Petitioner No. 1, a fresh Demand Draft in the name of the Registrar of this Court has been produced today.

2.

It appears to be an unnecessary mistake on the part of this Court in not accepting the Demand Draft in the name of Petitioner No.

1. However, now that the Demand Draft has been brought in the name of the Registrar of this Court, the Office shall accept the same and disburse the amount to Petitioner No. 1.

3.

The learned Advocate for Respondent No. 4 submits that he has brought a cheque in the name of Petitioner No. 2 in view of the aforesaid order. We direct the learned Advocate for the Petitioners to accept the same and acknowledge receipt thereof to Respondent No. 4. The learned Advocate for Respondent No. 4 also places on record a photocopy of the communication addressed by Respondent No. 4 to the Respondent / Special Land Acquisition Officer, stating that an amount of Rs. 61,861/- has been deposited with the Special Land Acquisition Officer as per the orders.

4.

It is informed by the learned Advocate for the Petitioners, as well as the learned AGP, that the amount of compensation has been paid to the Petitioners / Cheque has been handed over. 5.

Under such circumstances, we record that the order has been complied with.
