This present Writ Petition takes exception to order dated 16.01.2026, by which Petitioner's application for restoration of Regular Civil Suit No.271 of 2017 has been rejected. Apparently, petitioner had moved an application under Order IX Rule 9 of Civil Procedure Code for setting aside order of dismissal of suit. The Trial Court rejected said application vide impugned order dated 16.01.2026.

Order 43 Rule 1 (c) of Civil Procedure Code prescribes a remedy of filing appeal against order rejecting application for an order to set aside dismissal of suit.
