The order impugned in the present petition is appended at Exhibit 'H', page No. 61, and is dated 06.06.2022. The writ petition is filed after a hiatus of four years, in the year 2026. Upon perusal of the impugned order, it is prima facie observed by the Court that the same is not a rejection order. The proposal filed by the petitioner through the institution in which the petitioner is a Teacher has been rejected on the preliminary ground that there is inadequacy of the documents which are required to be appended to the proposal for consideration. Five documents which are required are specifically mentioned in the impugned communication/order dated 06.06.2022. The said order itself records that the aforesaid five 1 of

documents are required to be filed along with the proposal. However, the said communication has been construed by the petitioner as a rejection of the proposal. The petitioner being a Teacher, this Court would like to come to the aid of the teacher so that the case of the petitioner can be determined in accordance with law.

The petitioner and or the educational institution is given leave and liberty to file the five documents stated in the impugned communication/order dated 06.06.2022 before the Deputy Director of Education, Pune, Division Pune - ,1 along with the server copy of this order. If the petitioner files the five documents stated in the communication dated 06.06.2022 with the Deputy Director of Education, Pune, the said authority shall accept the same and determine the proposal which has been filed by the institution qua the petitioner as expeditiously as possible and, in any event, within a period of four weeks from the date of submission of the five documents.

Needless to state that if any hearing is required to be given to the petitioner-Teacher, the Deputy Director of Education shall give such hearing to the petitioner and ensure that the proposal is 2 of

considered strictly on the basis of merits and in accordance with law. All contentions of petitioner are expressly kept open without this Court expressing anything on merits of the matter. 4.
