IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO.2170 OF 2026 Sylvina Marian Carvalho through POA Marold M. Carvalho ....Petitioner
Versus
Thane Municipal Corporation through its Commissioner & Ors.
....Respondents ---- Mr. Mayuresh Lagu i/b. Mr. Sagar Patil, for the Petitioner. Ms. Chaitrali Deshmukh, Advocate for Respondent Nos.1 to 3. ---- CORAM : RAVINDRA V. GHUGE & ABHAY J. MANTRI, JJ.
DATE : 23rd FEBRUARY, 2026 P.C. :- 1.
The learned Advocate for the Corporation submits that since 2012, the Petitioner has been given notices. Every time, the grievance is that the principles of natural justice have not been followed. A hearing was earlier granted, three times. Now, again, the Corporation, as a last opportunity, has withdrawn the impugned notice and has listed the hearing in this matter on 5th March, 2026. According to the Corporation, the structure is unauthorized.
2.
The learned Advocate for the Petitioner submits that the Petitioner desires to withdraw this Petition with a humble prayer that the Corporation should consider all the contentions of the Petitioner and pass a reasoned order dealing with all such contentions.
3.
In view of the above, we observe that the Corporation would grant a reasonable opportunity of hearing to the Petitioner. The hearing shall be concluded within a period of 15 days from 5th March, 2026. The Petitioner would refrain from seeking adjournments on unreasonable or trivial grounds, lest, the Authority would close the matter for passing orders.
4.
Needless to state, Respondent No.1 would pass a reasoned order within a period of 21 working days after the hearing is concluded, and the said order would be served upon the Petitioner within 24 hours on the following E-mail Address /WhatsApp Number of the Petitioner :- E-mail Address :- Carvalhoh32@gmail.com WhatsApp Number :- 9870922224
5.
With the above observations and directions, this Petition is disposed off.
