Present petition takes exception to order dated 05.12.2025 passed by Labour Court, Ahmednagar in Application (IDA) No.19 of 2023.

Learned advocates appearing for petitioner and respondent no.2 have filed consent terms which are duly verified and signed by parties. It is submitted that parties have amicably settled dispute and set out consent terms which are enumerated in para 3. The consent terms are taken on record and marked as 'X' for identification.

Perusal of consent terms shows that those are verified by Mr. Ramrao Hanumantrao Kandekar, who is authorized on behalf of petitioner/company to execute all matters mentioned in consent terms and compromise writ petition. The authority letter signed by Vice Chairman and Managing Director Mr. Ajinkya Firodia is
4-wp-2397-2026.odt (2) appended to terms of compromise which is marked as 'A' for identification. The sum and substance of settlement is that petitioner/company agreed to pay sum of Rs.24 lakh (Rs. Twenty Four Lakh only) to respondent/workmen towards full and final settlement of all his claims against petitioner/company from orders passed by Labour Court in Complaint (ULP) No.57 of 1998 and Application No.19 of 2023.

In light of consent terms, respondent/workmen unconditionally withdraws Criminal Complaint No.06 of 2020 and consents for setting aside order dated 29.01.2026 passed by Labour Court, Ahmednagar. The respondent/workmen has also agreed to withdraw all pending cases before learned Industrial Court as well as Labour Court, Ahmednagar unconditionally with assurance that he will not initiate any proceeding in any manner against petitioner/company.

In light of consent terms, impugned orders are modified and writ petition stands allowed and disposed of in tune with settlement.
