IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION WRIT PETITION NO.2440 OF 2026 Sanjay Ambadas Patil ....Petitioner
Versus
The State of Maharashtra and Ors.
....Respondents ---- Mr. Avinash Belge for the Petitioner.
Mr. P.P. Kakade, Addl. GP a/w. Ms. P.N. Diwan, AGP for the Respondent - State.
Mr. Aadesh V. Konde-Deshmukh for Respondent Nos.5 and 6. ---- CORAM : RAVINDRA V. GHUGE & ABHAY J. MANTRI, JJ.
DATE : 20th FEBRUARY, 2026 P.C. :- 1.
A short issue is involved in this Petition.
2.
An innocuous prayer has been put forth by the Petitioner in the light of the judgment of this Court dated 15th July, 2025 delivered in Writ Petition No.14685 of 2024 (Babasaheb Dyanoba Garje v/s. Chaudhary Atar Singh Yadav Memorial Education Trust and Ors.) along with other connected matters. In the said judgment, this Court concluded that the orders passed by the Grievance Committee, unless challenged by the aggrieved parties
and the matter being sub-judice, are required to be implemented by the Management. If such orders are not implemented, the University would be obliged to exercise its powers under Statute No.1 of 2019, namely "The Maharashtra Public Universities (Penalties to be imposed upon Erring Affiliated Colleges/Recognized Institutions) Uniform Statutes, 2018" (hereinafter referred to as "the Penalties Uniform Statutes").
3.
As such, if the Management has challenged the order of the Grievance Committee, this Petition preferred by the beneficiary seeking directions to the University to give effect to the order of the Grievance Committee and to take action against the Management, would not survive, since the order of the Grievance Committee would then be subject to adjudication. However, if the order is not challenged, the University has to proceed expeditiously and initiate appropriate steps, including disciplinary action, under the Penalties Uniform Statutes.
4.
In this case, the Grievance Committee has passed order on 11th March, 2025 to the extent of directing Respondent
Nos.5 and 6 to refix the pay scale of the Petitioner in the Pay Band of Rs.15,600/- to Rs.39,100/- plus AGP of Rs.8,000/- with effect from 1st January, 2006 upto 10th August, 2008 and also directing Respondent Nos.5 and 6 to calculate the arrears of amount payable to the Petitioner. The learned Advocate for the Management, Mr. Konde-Deshmukh, who has strongly opposed this Petition and prayed that this Petition deserves to be dismissed, states, on instructions from the Management, that the order of the Grievance Committee is yet not challenged.
5.
In view of the above, this Petition is disposed off in the light of the final order of this Court dated 15th July, 2025 in Babasaheb Dyanoba Garje (supra).
6.
Needless to state, unless there is any legal impediment, the University would be at liberty to follow the course set out in Babasaheb Dyanoba Garje (supra) and take appropriate action in accordance with the Penalties Uniform Statutes, expeditiously. (ABHAY J. MANTRI, J.) (RAVINDRA V. GHUGE, J.)
