The challenge in this petition is to an order dated 04th December 2025 whereby the learned, City Civil Court has allowed the plaintiffs to deposit an amount of Rs. 16,67,142/- (Rupees Sixteen Lakhs Sixty Seven Thousand One Hundred and Forty Two) towards the consideration, subject to adjudication of dispute on merits.

The petition stands disposed with a clarification that, the aforesaid deposit shall be without prejudice to the rights and contentions of the parties, and the plaintiff shall not be entitled to claim any equities on the basis of the said deposit. [N. J. JAMADAR, J.] SAINATH, PA 2/2
