The learned Advocate for the petitioners challenges the order passed under Section 77A of the Maharashtra Cooperative Societies Act, 1960 ("the MCS Act"), whereby the Authorized Officer was substituted in place of the earlier Authorized Officer. It is noted that the validity of the order under Section 77A of the MCS Act has already been upheld by this Court in Writ Petition No. 1944 of 2023.

The impugned order, effectively, merely substitutes the earlier Authorized Officer. In view of this, no interference is warranted.

However, the apprehension expressed by the petitioners regarding the due date for deciding the eligibility of voters, or any other irregularities or illegalities concerning the provisional voters' list, may be addressed by instituting appropriate proceedings as permitted under the law.
