The petitioner is seeking expeditious disposal of his tribe claim of belonging to 'Koli Mahadev', Scheduled Tribe which has been submitted before Respondent No.2-Scrutiny Committee on 08.01.2026.

The learned Counsel for the petitioner submits that for nonsubmission of tribe validity certificate the employer has issued notice on 05.03.2026 calling upon the petitioner to submit the tribe validity certificate, failing which as per the clause of appointment order the services of the petitioner will be brought to an end. 4.
Learned AGP submits that the protection can be granted to the petitioner only for non-submission of tribe validity certificate and Narwade
-2nothing else.

We find that since the petitioner has been called upon to submit the tribe validity certificate within six (6) months from the date of appointment and since his tribe claim is pending before the Respondent No.2-Scrutiny Committee, we direct Respondent No.2Scrutiny Committee to decide the tribe claim of the petitioner as expeditiously as possible and preferably within a period of one (1) year from today.

During the pendency of the said tribe claim the employer of the petitioner shall not take any coercive action solely on the ground of non-submission of validity certificate. We also make it clear that this protection would be restricted only to the extent of non-submission of tribe validity certificate.

Needless to state that the protection granted by this Court will operate only till the tribe claim of the petitioner is decided. The petitioner shall not claim any equity.
