The petition arises out of an interim order passed in a Revision Application granting stay to the order of the Registrar under Section 75(5) of the Maharashtra Cooperative Societies Act, 1960 ("the MCS Act").

The apprehension expressed on behalf of the petitioners is that the Society is taking policy decisions, particularly regarding the appointment of a developer, which may affect the future management of the Society. However, the decision to appoint a developer is required to be taken in a General Body Meeting. The Managing Committee, by itself, cannot influence or finalize such a

9-wp-2869-2026.doc decision. Any such decision must be approved by the requisite majority of the members of the Society in accordance with law. 3.

In view of the above, the Revisional Authority is directed to decide the Revision Application expeditiously and in any case within a period of four weeks.

With the aforesaid directions, the writ petition stands disposed of. There shall be no order as to costs. (AMIT BORKAR, J.)
