The petitioner has filed this writ petition praying for a direction to Respondent Nos. 2 and 3 to pay half share of the compensation to him as determined in the award issued under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act of 2013). The second prayer pertains to the consideration of representation of the petitioner submitted recently on 09/01/2026, wherein the petitioner has claimed half share in the compensation amount. 2.
We are of the opinion that this Court in writ jurisdiction cannot go into the question with regard to the claim and the extent of share as projected on behalf of the petitioner in respect of the compensation amount. Sweety
8-WP-2968-2026.doc Sections 75 and 76 of the Act of 2013 pertain to the aspect of the apportionment of compensation.
3.
We find that the petitioner has recently, on 09/01/2026, submitted a representation to the Respondent Nos. 2 and 3 with regard to his grievance. In that light, we are inclined to dispose of this petition today itself by issuing appropriate directions, particularly in the light of the fact that all the respondent State authorities are represented by the learned AGP. 4.
In view of the above, the writ petition is disposed of by directing Respondent No. 2 Sub-Divisional Officer and the competent authority to decide the aforesaid representation of the petitioner dated 09/01/2026, strictly in accordance with law. The representation shall be decided expeditiously and preferably within a period of six weeks from today. (SHREERAM V. SHIRSAT, J.) (MANISH PITALE, J.) Sweety
