Heard the learned counsel for the Petitioner. 2.

By this petition, the Petitioner (auction purchaser) is seeking a limited direction for disposal of the proceedings pending before the Debt Recovery Tribunal - I, Mumbai (DRT).

Attention of this Court is invited to the order dated 29th August 2025, whereby the DRT permitted respondent No. 2 (secured creditor) to receive the amount from the petitioner (auction purchaser), but directed that the sale cannot be confirmed in favour of the petitioner till Interim Application No. 1685 of 2025, filed by respondent No.3 (borrower) is disposed of. It was further directed that the sale certificate shall also not be issued till the Interim Application is disposed of.

It is submitted that thereafter proceedings have been simply adjourned by the DRT. The Petitioner has parted with the bid amount and its Intervention Application is also pending before the DRT, while there is no progress at all towards hearing and disposal of the pending Interim Applications.

Considering the limited direction sought on behalf of the petitioner, we are of the opinion that service of notice upon respondent No.2-Bank and respondent Nos. 3 to 7 is not necessary, as expeditious disposal of proceedings before the DRT is in the interest of all the parties. Respondent No.1-State is a formal party, which is represented by the learned AGP.

We are of the opinion that the interim order dated 29th August 2025, passed by the DRT, is clearly adverse to the interest of the petitioner i.e. auction purchaser and it would be in the interest of all the concerned parties that the pending Interim Applications are heard and disposed of at the earliest.

In view of the above, the Writ Petition is disposed of by directing the DRT -I, Mumbai to dispose of the Interim Application No. 1685 of 2025 and Interim Application No. 2063 of 2025 at the earliest and in any case on or before 30th April 2026.
