Present writ petition raises challenge to the show cause notice dated 3.2.2026 issued by the Tahsildar, Jalgaon, District Jalgaon bearing no.114 of 2025, whereby the petitioner is called upon to show cause as to why penalty of Rs.36,345/- in terms of section 48 (7) and (8) shall not be imposed upon him. 2.

Record indicates that although petitioner is served with the impugned show cause notice and petitioner has replied the same, no final decision is taken by the Tahsildar. Even vehicle of the petitioner is not released or produced before S.D.O., who is the competent authority.

Learned A.G.P., on instructions, points out that final order is already passed in pursuance to the show cause notice impugned in this writ petition.

In that view of the matter, petitioner shall be at liberty to challenge the said order in appeal before appropriate forum. Writ Petition stands disposed of. Needless to state here that, if petitioner files an appeal against final order passed by the Tahsildar and deposits 25% of the amount as indicated in the show cause notice in terms of section 156 of the Maharashtra Land Revenue Code, petitioner's vehicle be released pending the appeal subject to imposition of the terms and conditions as deemed necessary by Appellate Authority. The release of vehicle pending appeal shall be subject to final decision of Appellate Authority.
