Heard the learned Counsel for the parties.

The challenge in this Petition is to an order dated 13 May 2025 passed by the Maintenance Tribunal under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. 3.

In view of the Division Bench judgment of this Court in the case of Jagdish Pitamber Pawar V/s. Pitambar Pundalik Pawar and Ors.1 an appeal against the order passed by the Maintenance Tribunal at the instance of the children or relatives is maintainable before the Appellate Authority. 4.

The Writ Petition, thus, stands disposed with liberty to the Petitioner to file an appeal before the Appellate Authority under Section 16 of the Act, 2007.

In the event such an appeal is filed within a period of three weeks from WP No.36 of 2023 dt. 29 November 2023 (Aurangabad Bench) SSP 1/2

26 wp 3114 of 2026.doc today along with an application for stay, the Appellate Authority shall hear and decide the said appeal as expeditiously as possible. 6.

The time spent by the Petitioner in prosecuting this Petition may be accounted for under Section 14 of the Limitation Act, 1963, in the event the question of limitation arises before the Appellate Authority.
