P.C.:- 1) Present Petition is thoroughly frivolous.

2) By the present Petition, the Petitioner is seeking a direction to Respondent No.1 to decide the Application dated 16th February, 2026, filed by the Petitioner under Section 77A(4) of the MCS Act, 1960 to replace the Respondent Nos.2,3 and 4 and to appoint new Authorized Officer in their place for the Respondent No.5 society.

3) Learned AGP produced on record a chart depicting the fact that, over the past one and half years, the Petitioner has filed as many as 16 complaints against the Society and/or its committee members constituted under the MCS Act. It appears to us that, the Petitioner is habitual 1/2

ssm 58-wp3122.2026.doc Complainant and is continuously filing complaints against the Management of the society with the Competent Authorities, making the Managing Committee difficult to take care of and/or to function the affairs of the Respondent No.5 Society.

4) In view of the above, learned counsel for the Petitioner on instructions from Mr. Anil G. Jani, husband of the Petitioner, who is personally present in the Court, seeks leave to withdraw Petition unconditionally.
