The petitioner impugns order dated 12.01.2026 passed by respondent no.1/District Sub Registrar, Parbhani in Proceeding No.1402/2023, whereby petitioner's application to issue witness summons to Assistant Sub Registrar, Parbhani has been rejected. 2.

The respondent no.2 initiated proceeding before respondent no.1 under provisions of Money Lending Act challenging Exchange Deed executed on 27.07.2017. In said proceeding, petitioner filed application to call Assistant Sub Registrar alongwith sale deed and other required documents. The said application is declined by respondent no.1.

Perusal of impugned order shows that parties have already filed certified copies of registered documents, which are subject matter of dispute. The application tendered by petitioner nowhere suggests as to why it is necessary to examine Assistant Sub

(2) 959-wp-3176-2026.odt Registrar. The respondent no.1 is, therefore, justified in rejecting prayer of petitioner. Hence, no case is made out to cause interference under Article 227 of Constitution of India. 4.

In result, Writ Petition stands dismissed.
