VERSUS

THE STATE OF MAHARASHTRA THR.

SECRETARY REVENUE DEPARTMENT AND ORS.

...

Advocate for the Petitioner : Mr. Sunil Mahadevappa Vibhute AGP/APP for Respondent/State : Mr. P.S. Patil ...

CORAM : SANDIPKUMAR C. MORE AND ABASAHEB D. SHINDE, JJ.

DATE : 25.03.2026 PER COURT : (PER : ABASAHEB D. SHINDE, J.) .

2.

By this Writ Petition, the petitioner is seeking expeditious disposal of his tribe claim of belonging to 'Koli Mahadev' Scheduled Tribe which is stated to have been pending with the respondent No.2/Scrutiny Committee since 26.12.2024.

3.

Learned counsel for the petitioner submits that during the pendency of the said tribe claim, the employer of petitioner has issued a show-cause notice dated 20.03.2026 thereby calling upon the petitioner to submit the tribe validity certificate, failing which the services of the petitioner would be brought to an end. 4.

Considering the same, we direct the respondent No.2/Scrutiny Committee to decide the tribe claim of the petitioner as expeditiously

2 PB-2.doc as possible and preferably within a period of six months from today. 5.

Till the tribe claim of the petitioner is decided, the employer/s of the petitioner shall not take any coercive action against the petitioner solely on the ground of non-submission of tribe validity certificate. 6.

Needless to state that the protection granted by this Court will operate only till the tribe claim of the petitioner is decided and the petitioner will not claim any equity.

7.

With these directions, the Writ Petition stands disposed of. ( ABASAHEB D. SHINDE, J. ) ( SANDIPKUMAR C. MORE, J. ) vsj..
