Present petition has been filed for following relief : "(B) By issuing a Writ of Mandamus or any other order or Writ of a like nature, the respondents-state authorities may please be directed to take decision upon the proposal submitted by the petitioner on 06.09.2024 for allotment of Government recognized backward class students residential hostel to the petitioner pursuant to advertisement dated 29.08.2024 issued by respondent No.2 - Commissioner, within some stipulated period of time and as early as possible."
WP_3376_2026 Learned AGP waives notice for respondent Nos.1 to 3. Learned Advocate Mr. S.B. Pulkundwar waives notice for respondent No.4. Learned AGP, upon instructions, has placed on record communication dated 10.09.2025 by Commissioner, Social Welfare Department to the Principal Secretary, Social Welfare Department and Special Assistance Department. It is taken on record by marking Exh. 'X'. According to this report, the petitioner is held to be ineligible, however, upon query, learned AGP submits that it is the report that has been submitted, however, the matter is still pending with respondent No.1 - Principal Secretary. He could not take the instructions as to when he would take final decision on the said proposal.
We dispose of the writ petition by directing Principal Secretary, Social Welfare and Special Assistance Department, Mantralaya, Mumbai to decide the proposal submitted by petitioner on 06.09.2024 within a period of four weeks from today, and communicate the same within one week of its decision to the petitioner.
