ORDER :

The Petitioners are seeking extension of the applicability of the Order dated 5th February, 2024 passed in Writ Petition No.10225 of 2017 to them. Further, direction is sought to the Industrial Court, Thane to consider the eligibility of each of the Petitioners in terms of Order dated 5th February, 2024 passed in Writ Petition No.10225 of 2017 for which application be permitted to be filed before the Industrial Court, Thane as contemplated in the Order dated 5th February, 2024. Direction is also sought to decide the application of the Petitioners within a period of six months from the 1/3

date the application is made.

The learned Counsel for the Petitioners has referred to the Order dated 22nd January, 2026 on the basis of which the same prayer had been granted. He has submitted this Court had extended the applicability of the benefits of the Order dated 5th February, 2024 to the Petitioners who were not parties to the Writ Petition No.10225 of 2017 but were similarly placed and who were directed to file application before the Industrial Court for execution of the Order dated 25th January, 2010 ('said Order') passed by the Industrial Court.

The learned Counsel appearing for the Petitioners has submitted that present Petitioners are also similarly placed to those Petitioners and accordingly he has sought for similar relief be granted.

This application has not been opposed by the Respondents without prejudice to their rights and contentions. 5.

Accordingly, the present Petitioners are permitted to file application before the Industrial Court within a period of four weeks from today.

The Industrial Court is directed to examine the case of each of the Petitioners with regard to their eligibility as of 25th January, 2010, in accordance with the consent terms dated 26th June, 2016, arrived at before this Court in Writ Petition No.7060 of 2010.

Upon the Petitioners being found to be eligible, the Industrial Court may issue the necessary orders to the Respondent - Corporation for compliance with the said Order. This exercise shall be carried out by the Industrial Court within a period of six months from the date of the application.

We have not expressed any opinion on the merits of the matter.
