Present petition has been filed for following reliefs : "B.

The impugned order dated 15.10.2025 passed by respondent No. 2 bearing number JAA/KRA. 912/2025 be quash and set aside.

The respondent No. 2 may kindly be directed to reinstate the petitioner on her past of promotion which is "Aganwadi Sevika" at quash and set aside." 2.

Heard learned Advocate for the petitioner, who has taken us through the documents. According to the petitioner, the order dated 15.10.2025 was not immediately serve to her. It was along with letter dated 25.11.2025 which the petitioner had refused to accept, but later on came to know about her termination. The termination of the petitioner is illegal.

When the queries were made as to why the petitioner had not approached the Divisional Commissioner, Chhatrapati Sambhajinagar Division as per clause 6A of Government Resolution dated 02.02.2023, wherein a specific provision has been made for complaint and appeal, the answer was that the said order was delivered late, and now, the petition has become time barred; but when insisted upon, he submitted that the letter was not served immediately to her.

We are not going into the details of the facts so conveyed about delay and serving the order. The only fact is that there is alternate efficacious remedy available as per the Government Resolution. The learned Advocate for the petitioner then seeks liberty to the petitioner to approach the Divisional Commissioner.

We allow the petitioner to withdraw the petition and approach the Divisional Commissioner, Chhatrapati Sambhajinagar Division. However, the point regarding limitation is kept open. (Hiten S. Venegavkar, J.) (Smt. Vibha Kankanwadi, J.) B. S. Joshi 30-WP-3494-2026.odt
