DATED : 23rd MARCH, 2026 P.C. :- 1) In our opinion, in the light of the Communication dated 3rd August, 2022 addressed by MHADA to the Petitioner, it is not possible for us to entertain the present Petition which seeks the following reliefs :- " b. This Hon'ble Court be pleased to issue the Writ of Mandamus or Certiorari or any other appropriate Writ/order/ direction directing the Respondent No.01 to take action against Respondent No.02 and 03. "

2) It is open for the Petitioner to challenge the Order dated 3rd August, 2022 by filing appropriate proceedings. Further, if it is a case of the Petitioner that the Petitioner is causing a nuisance by his acts, it is for the Petitioner to resort to appropriate remedies provided by law. Only on the basis of the statement that the Petitioner is causing nuisance to the 1/2

P.H. Jayani 50 WP3529.2026.doc occupants, is not sufficient for us to grant any relief in favour of the Petitioner. If the Petitioner approaches the Competent Forum and makes a grievance against the Respondent No.2, the Competent Forum shall obviously look into such a grievance.
