The present Writ Petition is filed with following prayer clauses:
B)The respondents No.1 to 6 may kindly be directed to conduct the by election of Grampahcyat Chikhali TQ. Ashti District Beed for the post of Sarpanch from Scheduled Tribe candidate for five year within one month.
C)The respondents No.1 to 6 may kindly be directed to consider and decide the applications of the petitioner dated 29.04.2025, 12.08.2025, 09.09.2025, 14.01.2026 in respect of conduct the by election of Grampanchayat Chikhali Tq. Ahsti District Beed for the post of Sarpanch from scheduled Tribe candidate within one month.

The learned AGP points out that Respondent No. 7 is elected from reserved category. She has submitted her nomination along with affidavit cum undertaking in terms of Section 10(1-A) of the Maharashtra Village Panchayat Act. Since she had not submitted caste
908-WP-3550-2026.odt validity within prescribed time, proceedings for disqualification was taken up. However, State Government under Circular dated 30.04.2025 extended time for furnishing caste validity certificate by one year. 3.
In light of aforesaid extension of time prescribed under Section 10(1-A), question of disqualification of Respondent No. 7 would arise after expiry of period of one year. As on today, vacancy does not exist to conduct election on post held by Respondent No. 7. In that view of matter, there is no reason to entertain the present Writ Petition and same stands dismissed.
