A limited prayer in this petition is to direct the learned Civil Judge, Junior Division, to hear and decide the application SANTOSH SUBHASH KULKARNI SANTOSH SUBHASH KULKARNI Date: 2026.04.04 11:30:16 +0530 for rejection of the plaint (Exhibit-73) under the provisions of Order VII Rule 11 of the Code of Civil Procedure, 1908. 3.

The learned Counsel for the petitioners invites the attention of the Court to the copy of the roznama of the proceedings dated 21st September, 2024, which indicates that the learned Civil Judge had heard the said application for rejection of the plaint and posted the same for orders on 10th October, 2024.

It is the grievance of the petitioners that since then, the said application has not been decided.

The submission of the learned Counsel for the petitioners is borne out by the roznama of the proceedings dated 21st September, 2024.

The learned Counsel for the petitioners further submitted that the Presiding Officer, who had heard the matter, has since been transferred and the suit is now listed before the learned Civil Judge on 9th April, 2026.

Thus, the learned Civil Judge is requested to hear and decide the application for the rejection of the plaint as expeditiously as possible and, preferably, within a period of three months from 9th April, 2026, the next scheduled date for the listing of the suit.
