Considering the prayers made in the present petition, the reliefs sought are wholly misconceived. The first relief seeks a direction against the Society to provide loan documents.

It is well settled that a Cooperative Credit Society does not fall within the meaning of "State" as contemplated under Article 12 of the Constitution of India. In view thereof, such direction cannot be issued.

Insofar as the second prayer is concerned, which seeks directions against the Society as well as the Competent Authority, i.e., the Chief Judicial Magistrate, the same cannot be entertained in a writ petition in view of the judgment of this Court in Amit Prakash Jori & Anr. v. The State of Maharashtra & Ors. (Writ Petition No. 1331 of 2025, decided on 4th February 2025). 4.

Accordingly, the petition stands dismissed.

It is clarified that this Court has not considered merits of the contentions raised on behalf of the petitioner. 6.

In view of the dismissal of the petition, the interim application does not survive and stands disposed of accordingly. (AMIT BORKAR, J.)
