By this petition, the petitioners are seeking limited relief for a direction to the Debts Recovery Tribunal, Pune (DRT) to expeditiously decide the pending Securitisation Application No.54 of 2021.

We find that the said application was filed as far back as in the year 2021. We are informed that the respondent-bank (secured creditor) has not filed reply affidavit till date and the proceedings are languishing.

We are of the opinion that a direction for expeditious disposal of the pending proceedings, inures to the benefit of all the concerned parties and therefore, it is not necessary to issue specific notice to the respondent-bank before passing any order in the present petition. The statutory mandate under the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, is that such an application should be disposed of within 60 days.

Considering the fact that the said application has been filed before the DRT about 5 years ago, it would be appropriate that the same is disposed of at the earliest.

In view of the above, the writ petition is disposed of by directing DRT-Pune to dispose of the pending Securitisation Application No.54 of 2021 as expeditiously as possible and preferably within 60 days from today. Pending applications, if any, also stand disposed of.
