....Petitioners

Versus

The State of Maharashtra & Anr.

....Respondents ---- Mr. Suresh Pakale (Senior Advocate) a/w Mr. Nilesh Desai i/b. Ms. Padmaja Malgaonkar, for Petitioners.

Mr. S. V. Gavand a/w. Mr. P. H. Gaikwad, for Zilla Parishad Pune/Respondents.

Mr. P. P. Kakade, Addl. GP a/w. Ms. D. S. Deshmukh, AGP for the State.

---- CORAM : RAVINDRA V. GHUGE & HITEN S. VENEGAVKAR, JJ.

DATE : 17th APRIL, 2026 P.C. :- 1.

Heard the learned Senior Advocate for the Petitioners, the learned Additional GP/AGPs for the State, and the learned Advocate for the Zilla Parishad.

2.

The learned Advocate for the Zilla Parishad has prepared a ready reference chart (6 pages), indicating minute details of each of these Petitioners. We appreciate the efforts taken by the learned Advocate, Mr. Gavand, and the said compilation is taken on

record and marked as 'X' collectively for identification. 3.

In this Petition, except for two Petitioners, namely Mr. Kailas Bhima Gunjal and Mr. Ramesh Shankarrao Marne, the remaining Petitioners would be completing 53 years of age in the latter half of 2026. These two Petitioners are already posted in a difficult area and shall continue to work in the difficult area until they attain the age of 53 years. They will, therefore, have to continue for the Academic Year 2026-2027 in the difficult area. 4.

Accordingly, this Petition is disposed off with liberty to the said two Petitioners, Mr. Gunjal and Mr. Marne, to apply in the month of May 2027 for a posting in a simple area through the Zilla Parishad portal. As they would have completed 53 years of age by May 2027, the Zilla Parishad shall consider their cases for posting outside the difficult area.

5.

Insofar as Mr. Subhash Jaysing Bhagat is concerned, he is similarly placed as the two Petitioners in Writ Petition No. 3693 of 2026. For the reasons recorded therein, his claim in the present Petition stands rejected.

6.

This Petition is, therefore, disposed off.
