The petitioner is aggrieved by an order dated 23rd SANTOSH SUBHASH KULKARNI December, 2025 passed by the learned Civil Judge, Senior SANTOSH SUBHASH KULKARNI Date: 2026.04.04 11:30:13 +0530 Division, Khed-Rajgurunagar, dated 23rd December, 2025, whereby in the application for interim injunction, preferred by the petitioner, in RCS/441/2025, the trial Court declined to grant an ex parte ad-interim relief and issued notice to the respondents.

The learned Counsel for the petitioner submitted that the notices have been issued by the authorities under the Mamlatdar's Courts Act, 1906, to execute the orders passed by the Tahsildar under Section 5 of the said Act. 1/2

Since the interim application is pending, there is no propriety in entertaining this Petition at this stage, It would, however, be necessary that, the said application is heard on the point of ad-interim relief, Thus, the petitioner is permitted to move the trial Court and seek an expeditious hearing of the application for temporary injunction in RCS/441/2025. 5.

In case such an application is moved on or before 10th April, 2026, the trial Court is requested to prepone the hearing in RCS/441/2025 and, after giving notice to the parties, hear and decide the application for temporary injunction in RCS/441/2025.
