IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 4032 OF 2026 Sushil Rampal Baldava

VERSUS

Keshav Ambadas Yakhande And Anr ...

Advocate for the Petitioner : Mr. Nawale Sayaji Shivaji ...

CORAM : S. G. CHAPALGAONKAR, J.

DATED : APRIL 18, 2026 PER COURT :- 1.

Present petition takes exception to order dated 03.12.2025 passed by Civil Judge Senior Division, Aurangabad in Special Civil Suit No.128 of 2013 thereby rejecting petitioner's application Exhibit-100 seeking direction against defendant no.2 to produce copies of so-called sale deeds.

2.

Perusal of proceeding shows that application was tendered at fag end of proceeding when matter was fixed for final arguments before Trial Court. The Trial Court observed in para 4 that plaintiff wants defendant no.2 to file better particular of his ownership. However, such provision is already omitted from Civil Procedure Code. Moreover, Trial Court observed that plaintiff was well aware about sale deed as it was subject matter of R.C.S. No.206 of 2005. In this backdrop, the Trial Court desisted to entertain the application.
