CORAM:
N. J. JAMADAR, J.
DATE :
15th APRIL 2026 P.C.:
1.
Heard the learned counsel for the Petitioner. 2.
The challenge in this Petition is to an order dated 9th February 2026 passed by the learned Arbitrator in the arbitration proceedings between the parties.
3.
Having regard to the nature of the issues raised before the learned Arbitrator, to question the jurisdiction of the learned Arbitrator, under Section 16 of the Arbitration and Conciliation Act, 1996, prima facie, this Court is of the view that the issues are rooted in facts and are adjudicatory in nature. These issues are not amenable to resolution in a writ petition as scope of interference in an order passed under Section 16 of the Arbitration and Conciliation Act, 1996, is very limited. 1/2
31-WP-4039-2026.DOC 4.
The Petition thus stands disposed with liberty to the Petitioner to raise all the contentions before the learned Arbitrator, as well as in proceedings under Section 34 of the Arbitration and Conciliation Act, 1996, in the event the Petitioner is aggrieved by the final award that may be passed by the learned Arbitrator.
