By the present Petition, the Petitioner who was a party to Appeal VARSHA DEEPAK GAIKWAD Date: 2026.04.02 15:38:10 +0530 No. 246 of 2013 before the Debt Recovery Appellate Tribunal, Mumbai (DRAT) and even in the original proceedings before the Debts Recovery Tribunal-III, Mumbai (DRT) has challenged the order passed way back on 18/01/2023 by the DRAT.

Respondent No.1-Bank has appeared through counsel who informs this Court that during the interregnum i.e. the period of more than three years between the date of the impugned order and the filing of the present Writ Petition, crucial subsequent events have taken place, including physical possession of the property being taken, auction being conducted and the auction purchasers also coming into the picture.

We find that these said subsequent events are crucial and important for examining as to whether this Writ Petition can at all be entertained, in the light of the fact that the petitioner has chosen to approach this Court more than three years after the passing of the impugned order by the DRAT.

In that light, Respondent No. 1-Bank is permitted to file a short affidavit to place on record the events that have taken place after the impugned order dated 18/01/2023 was passed by the DRAT. 5.

The affidavit shall be placed on record within two weeks from today.

List the Petition under the category of fresh matters on 22nd April 2026.
