Present writ petition takes exception to the order dated 20.3.2026 passed by the Additional Divisional Commissioner, Chhatrapati Sambhajinagar, in file no.2026/GP/Appeal2/CR/06 whereby petitioner's prayer for stay to the disqualification order passed by the District Collector, Beed is rejected.

Mr. Gandle h/f Mr. Salunke, learned advocate appearing for petitioner submits that petitioner has been wrongly disqualified ignoring report of Extension Officer, which clearly stipulates that there was no encroachment as on the date of

wp 4206.2026.odt panchnamna. As such, disqualification under section 14 (1)(j3) of Maharashtra Village Panchayat Act would not attract. 3.

Mr. Wagh learned advocate appearing for respondent no.6 submits that learned Divisional Commissioner, Chhatrapati Sambhajinagar has posted the appeal for hearing on 13.5.2026. If this Court directs expeditious disposal of the appeal, purpose would be served. He would further point that petitioner has already handed over charge to the Deputy Sarpanch.

In light of the aforesaid submissions, without delving into merits of contentions of the parties, purpose would be served, if Divisional Commissioner decides pending appeal expeditiously. Hence, writ petition stands disposed of, with request to the learned Divisional Commissioner, Chhatrapati Sambhajinagar to hear and decide the appeal filed by the petitioner on 13.5.2026, which is date scheduled for hearing of the appeal.
