The petitioners raises challenge to the order dated 21.2.2026 passed by learned Civil Judge J.D. Degloor, in R.C.S. No.524 of 2025, whereby the status-quo order dated 29.1.2026 passed below Exhibit-16 has been vacated.

Mr. Reddy, learned advocate appearing for petitioners submits that on 29.1.2026 Trial Court was pleased to pass order below Exhibit-16 in R.C.S. No.524 of 2025, thereby directing both the parties to maintain status-quo in respect of the disputed property mentioned in claim clause of the plaint. He submits that defendants sou-motu appeared before Trial Court and submitted application dated 21.2.2026 and prayed for vacating of interim relief/status quo order. Said

wp 4207.2026.odt application has been decided in absence of the petitioner/plaintiff and status quo came to be vacated. Now, the matter is adjourned beyond the vacation.

Learned advocate appearing for the respondents/caveator supports order impugned. He submits that the status-quo order was to operate till appearance of the defendants. Defendants have caused appearance, filed their say/written statement and there was no impediment for deciding the application Exhibit-5.

Considering submissions advanced by learned advocates for the parties, writ petition can be disposed of by passing a innocuous order. Parties to appear before the Trial Court on 4.5.2026.

The parties shall complete their submissions/arguments on Exhibit-5 and Trial Court shall decide the same by 8th June, 2026.

Till then, status quo as granted vide order dated 29.1.2026 in R.C.S. No.524 of 2026 shall remain in-force. ( S. G. CHAPALGAONKAR, J. ) ...
