Present writ petition takes exception to order dated 8.5.2025 passed below Exhibit-9 by the Civil Judge J.D. Purna in Regular Darkhast No.10 of 2021.

Mr. Kalani, learned advocate appearing for the petitioner submits that impugned order is passed on 8.5.2025 for recovery of dues of maintenance of Rs.1,80,000/- against the petitioner. Executing Court had directed petitioner's employer i.e. Divisional Railway Manager, Nanded to deduct amount of Rs.22,308/- p.m. from the salary of petitioner till realization of outstanding amount of Rs.1,80,000/- By this time, the amount is already recovered, however, there is apprehension that on the basis of aforesaid order, the employer of the

wp 4215.2026.odt petitioner would continue to deduct the said amount from his salary in absence of the directions to that effect. 3.

Petitioner has not brought on record any instance showing that any amount beyond Rs.1,80,000/- is recovered by his employer, dehors directions given by Executing Court. If recovery from petitioner's salary is made by his employer without any directions by Executing Court, petitioner would have his own remedy before appropriate authority. However, since impugned order is already executed, no indulgence is required under writ jurisdiction of this Court. Writ Petition stands disposed of with liberty in favour of the petitioner. ( S. G.
