Heard learned Counsel - Mr. A.V. Patil Indrale for petitioner. 2.
It is contention of petitioner that Deputy Director of Education has no jurisdiction to entertain challenge/objection to approval granted by competent authority. Petitioner has specifically raised a preliminary objection before respondent No.2 regarding maintainability of proceeding, however respondent No.2 has closed matter for orders. Petitioner apprehends adverse order by respondent No.2 without deciding issue of jurisdiction.

This Court finds that if respondent No.2 has already closed proceedings for orders, there is no need to pass any order in exercise of writ jurisdiction. In case adverse order is passed by respondent No.2,
2 1 WP 4244-2026.odt which is beyond jurisdiction, petitioner would be at liberty to avail appropriate remedy in accordance with law.

However, it is expected that respondent No.2 would consider exposition of law by Full Bench of this Court in case of Namdeo s/o Vishnu Sase Vs. State of Maharashtra and Ors., reported in 2023 (2) Mh.L.J. 598, whereby parameters of jurisdiction of Deputy Director of Education in matter of approval have been laid down. It has been held that, Deputy Director of Education has no jurisdiction to cancel approval granted by Education Officer.

With these observations and keeping all contentions open, Writ Petition stands disposed of.
