The present Writ Petition takes exception to order dated 12.03.2026 passed by Additional Divisional Commissioner, Chhatrapati Sambhajinagar in File No.2026/G.P./Appeal-2/CR.07, whereby petitioners' application for stay to order of disqualification by District Collector in Dispute No.12/2024 is rejected. 2.
Undisputedly, District Collector passed order holding that petitioner has incurred disqualification in terms of Section 14(J-3) of Maharashtra Village Panchayat Act (for short 'MVP Act'). The petitioners exhausted statutory remedy under Section 16 of MVP Act and filed Appeal before Divisional Commissioner at Chhatrapati Sambhajinagar. The Appeal is still pending for consideration on merit.
It is expected that Divisional Commissioner would consider Appeal on its own merit and

In aforesaid circumstances, Writ Petition can be disposed of with innocuous order directing Divisional Commissioner, Chhatrapati Sambhajinagar to decide pending Appeal within period of four weeks from today. Parties to co-operate. 4.
Till then, there shall be stay to order of disqualification passed by District Collector in Dispute No.12/2024. (S. G. CHAPALGAONKAR) JUDGE Devendra/April-2026
