In this petition, we find prima facie that the Registrar of the Debts Recovery Tribunal, Pune (DRT) could not have declined registration of the securitisation application filed on behalf of the petitioners. The relevant provision of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (Securitisation Act) is absolutely clear, as it facilitates filing of such application by any person aggrieved by action taken under the provisions of the Securitisation Act. 2.

The petitioners are permitted to serve respondent Nos.2 to 5 additionally by way of private service and to file an affidavit of service before the next date of listing.

It is made clear that if the petition is not disposed of finally, on the next date, this Court will consider the prayer for interim relief made on behalf of the petitioners.
