2026:BHC-AUG:17925-DB
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD 932 WRIT PETITION NO. 4352 OF 2026 DIGAMBAR BARIKRAO ANDIL
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS ...
Mr. S.E. Shekade, Advocate for petitioner Mr. R.S. Wani, AGP for respondent Nos.1 to 3 ...
CORAM :
SMT. VIBHA KANKANWADI & AJIT B. KADETHANKAR, JJ.
DATE :
22nd APRIL, 2026 ORDER :
.
Heard learned Advocate for petitioner. Learned AGP waives notice for respondent Nos.1 to 3.
Ultimately Award is passed on 02.03.2026. However, the petitioner states that the petitioner has not been paid the interest payable under Section 80 of the Act, 2013. The petitioner states that even the Award amount has not been paid.
This is another classic example where the Award is not passed
932_WP_4352_2026 within a reasonable period and amount is also not paid. This Court has given extensive directions in various matters. We are at pains to observe that the Government is not even taking those orders seriously. Before ultimate time comes, we are granting the respondents one opportunity to pay the compensation amount as well as the amount under Section 80 of the Act. Respondent No.2 should decide the representation dated 05.03.2026 within a period of two months and pay the entire compensation amount as well as the interest under Section 80 of the Act by calculating the same on or before 01.07.2026.
With these directions, we dispose of the writ petition. ( AJIT B. KADETHANKAR, J. ) ( SMT. VIBHA KANKANWADI, J. ) agd
