(C) By issuing the appropriate writ, order, direction or any other appropriate order in nature of writ the Hon'ble High Court may be please to direct respondent No.7 to implement the judgment and order passed by respondent Nos.2, 3, 4 and cancelled the mutation

Heard learned Advocate Mrs. Vanita H. Sangole Jaitmal for petitioner and learned AGP for respondents/State. Though the petitioner has tried to give the colour to the petition seeking directions to consider the representation filed by the petitioner, in fact, the petitioner wants that respondent should implement the Judgment and order passed by respondent Nos.2 to 5 and cancel the Mutation Entry. Further, it appears that Regular Civil Suit No.49/2014 is still pending before the Civil Court at Aundha Nagnath. When it comes to the implementation of the orders by the revenue authorities, then petitioner should reach till the highest officer in the hierarchy. The petitioner cannot come to this Court by giving a colour for directions to decide the representation.

We do not find this to be a fit case where we should exercise our powers under Article 226 of the Constitution of India. The petition stands dismissed. However, the petitioner is at liberty to adopt appropriate proceedings for getting the orders implemented as is provided under the Maharashtra Land Revenue Code. ( AJIT B. KADETHANKAR, J. ) ( SMT.
